<description>I wanted to pass along the following item in the event that it may be of interest to your readers.  

Today I won a judgment in King County District Court for the unauthorized use of one of my digital photographs by a commercial real estate broker.  I think this story would be relevant to any digital photographer or anyone else in the creative arts who creates intellectual property that is shared or distributed on the Internet.  There&#8217;s also a bit of a David and Goliath hook to it too.

I am a freelance photojournalist who has shot for a range of print and online news outlets in the US and abroad.  Here in Seattle my work is mostly featured in the West Seattle Blog (WSB)where I&#8217;m a paid, accredited photographer, though my photographs have also appeared in Seattlest too.

Last November the WSB covered the closing of the Beato restaurant at 3247 California Ave SW.  I went out and grabbed an image which appeared at the top of the Blog (over my credit) the following morning. Six months later I was researching some commercial real estate listings in West Seattle when I stumbled upon my image of Beato which had been posted on a commercial real estate broker&#8217;s listing for the restaurant.  I made a few attempts to contact the listing agent, Laura Miller of Catalyst Commercial Partners, but she chose to ignore me.  I did manage to get the webmaster for the site to remove the image.  Whereas I would have been satisfied to have resolve the matter with a polite apology, the fact that the real estate agent refused to be responsible for what she had done motivated me to defend my copyright in court.

So earlier today Judge Judith Eiler heard the case here in Seattle.  Once she established the image was mine and that it had been published over my name, she asked Ms. Miller why she felt she was not responsible for the use of the image.  Ms. Miller&#8217;s only defense (other than that her assistant had acquired and uploaded the image) was that they did not know where the image had come from.  She said they never pay for images and get them from multiple places.  The judge admonished her that &#8220;Just because it is on the Web doesn&#8217;t mean it is free.&#8221;   I think Ms. Miller&#8217;s excuse was as unreasonable as a thief who, when caught with stolen merchandise, tells a police officer that it was OK because he didn&#8217;t know where the merchandise had come from.  Apparently the judge agreed.

I was awarded the full damages I was seeking plus court costs.  I&#8217;m obviously delighted with the outcome and happy to have had a judge who appreciates the value of intellectual property.  As a freelance journalist, without the big legal department of a media giant behind me, it is reassuring that I was able to be successful without having to go to the trouble and expense of hiring an attorney and filing a case in Federal court.  Though in my research I did discover a Federal case from last year with almost the same merits.  And in that case the photographer won a successful judgment against a commercial real estate company for $12 million!

I&#8217;d be happy to discuss this with you further if you think it might be something of interest to your audience.  I&#8217;d like to get the word out to amateur and semi-pro photographers alike that there can be a fairly simple recourse when a commercial interest steals their intellectual property and uses it for profit without their permission.  </description>

We watched it for about two minutes from our apartment window on Cap. Hill (on 15th), then headed up to our roof deck.  By the name we got there, the occurrence had disappeared.  This is by far the strangest sky-related or atmospheric event to which I have ever been witness. Any insight, anyone?  Although I hyperbolize, it appeared almost apocalyptic! </description>
